Terms of Use
These Terms of Use ("Terms") govern your use of the Notavite mobile application and related services, published by Blue Jay Systems. By creating an account or using the app, you agree to these Terms.
1. Publisher and purpose
Notavite is an AI-assisted note-taking application ("second brain") published by Blue Jay Systems ("we", "us"). Contact: support@notavite.com.
These Terms define the conditions of access to and use of the service by you. They are supplemented by our Privacy Policy.
2. Acceptance and minimum age
The service is reserved for people aged 16 or over. By creating an account, you confirm that you meet this requirement and accept these Terms.
3. Description of the service
Notavite lets you, among other things:
- capture content (text, voice, links, images, PDFs) and sync it across devices;
- have that content automatically processed by AI (title, summary, tags, detection of dates and actions);
- search in natural language and, depending on your plan, chat with your notes;
- receive reminders, a daily or weekly digest ("The Brief"), and use import/export features.
AI limitations: AI-generated content (summaries, titles, answers, action detection) may be inaccurate or incomplete. It is provided for information only and does not constitute professional advice. You remain solely responsible for verifying important information (appointment dates, deadlines, etc.).
The free plan is subject to quotas (number of captures, AI analyses, searches and debriefs per month, voice memo duration). These quotas are shown in the app and may change under the conditions of section 11.
4. User account
- You agree to provide an accurate email address and to keep your password confidential.
- You are responsible for all activity carried out from your account.
- In case of unauthorized use of your account, contact us without delay at support@notavite.com.
5. Pro subscription
The Notavite Pro subscription unlocks paid features (unlimited captures and searches, chat with your notes, the daily Brief, unlimited voice debriefs, voice memos up to 5 minutes, priority processing).
- Price: €4.99/month billed annually (€59.99/year) or €8.99/month billed monthly. The prices displayed in the app at the time of purchase prevail; they include applicable VAT.
- Free trial: 7 days. No charge during the trial; the subscription starts automatically at the end of the trial unless cancelled.
- Automatic renewal: the subscription renews automatically at each term unless cancelled at least 24 hours before the end of the current period.
- Management and cancellation: purchase, billing and cancellation are handled by the App Store (Apple) or Google Play, from your store account settings. We never see your payment details.
- Right of withdrawal: by requesting immediate access to digital content, you expressly waive your 14-day right of withdrawal where applicable (Art. L221-28 of the French Consumer Code). Apple's and Google's refund policies also apply.
6. User content
You remain the full owner of the content you capture in Notavite (notes, files, recordings). You grant us only a limited, non-exclusive, revocable licence to store, reproduce and process that content strictly as needed to operate the service (sync, AI processing, search, backup). This licence ends when the content or the account is deleted.
You warrant that you hold the necessary rights to the content you import and that it does not infringe third-party rights.
7. Prohibited uses
You may not use the service to:
- store or distribute unlawful or infringing content, or content that violates third-party rights;
- attempt to bypass security measures, quotas or technical limitations;
- access or attempt to access other users' data;
- resell, sub-license or commercially exploit the service without our written consent;
- deliberately overload the infrastructure (mass scraping, abusive automation).
Breach of this section may lead to suspension or termination of the account.
8. Intellectual property
The application, its brand, design, texts and code are protected by intellectual property law and remain the exclusive property of Blue Jay Systems. No rights other than those expressly provided here are granted to you.
9. Availability and liability
We strive to keep the service continuously available but cannot guarantee uninterrupted availability (maintenance, incidents, reliance on third-party providers).
To the extent permitted by law, our liability is limited to direct and foreseeable damages and shall not exceed the amounts you paid us over the previous twelve months. Nothing in these Terms excludes our liability for gross negligence, fraud, or personal injury.
Back up your data: a full export feature (Markdown, PDF, ZIP archive) is available at any time in the app. We recommend exporting important content regularly.
10. Termination and account deletion
You may stop using the service and delete your account at any time from the app (see Delete your account). Deletion is immediate and permanent: all your data is erased, including stored files. Deleting the account does not automatically cancel an active subscription — cancel it from the App Store or Google Play.
We may suspend or terminate an account in case of serious or repeated breach of these Terms, with prior notice except in urgent cases.
11. Changes to these Terms
We may update these Terms. For material changes, you will be informed by email or in-app notification at least 14 days before they take effect. Continued use of the service after that date constitutes acceptance.
12. Governing law and mediation
These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought first. Under Articles L611-1 et seq. of the French Consumer Code, you may use a consumer mediator free of charge. You may also use the European online dispute resolution platform: ec.europa.eu/consumers/odr. Failing that, the French courts shall have jurisdiction.
